Agreement to Terms

By accessing or using My Online Designer's services, you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of the terms, you may not access our services.

Services Description

My Online Designer provides digital services including but not limited to:

• Strategy & Consulting
• Design & UX/UI
• Software & Application Development
• Digital Marketing & Content
• Cloud & IT Services
• Cybersecurity & Risk Management
• Emerging Technologies & Innovation

Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information
• Cooperate in the project development process
• Provide timely feedback and approvals
• Make timely payments as agreed
• Respect intellectual property rights

Payment Terms

Payment terms will be specified in individual project agreements. Generally:

• Projects may require an initial deposit
• Milestone payments for larger projects
• Final payment upon project completion
• Late payments may incur interest charges

Intellectual Property

Unless otherwise agreed in writing:

• Clients own the final deliverables
• My Online Designer retains rights to portfolio usage
• Pre-existing intellectual property remains with respective owners
• Open-source components retain their original licenses

Confidentiality

Both parties agree to maintain the confidentiality of proprietary information received from the other party. This includes:

• Business strategies and plans
• Technical information and trade secrets
• Client and user data
• Project details and specifications

Warranties and Limitations

Services are provided "as is" without warranties of any kind. We strive to provide high-quality services but cannot guarantee specific business outcomes or results.

Limitation of Liability

To the maximum extent permitted by law, My Online Designer shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services.

Indemnification

You agree to indemnify and hold harmless My Online Designer from any claims, damages, liabilities, and expenses arising from your use of our services or violation of these terms.

Termination

Either party may terminate services with written notice. Upon termination:

• Outstanding payments become due immediately
• Work completed up to termination point will be delivered
• Confidentiality obligations survive termination

Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction where My Online Designer is based, without regard to its conflict of law provisions.

Dispute Resolution

In the event of any dispute, the parties agree to first attempt to resolve the matter through good-faith negotiations. If unresolved, the parties may pursue mediation or arbitration.

Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes. Continued use of our services after changes constitutes acceptance of the new terms.
